AetherCraft Studio provides mobile applications and games, including but not limited to:

• Utility and productivity applications
• Customer support and related services

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice.

4. User Accounts

4.1 Future Account System

Note: The following terms apply only if an account system is added in future versions.

If we implement user accounts in the future:

4.1.1 Account Creation

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

4.1.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4.1.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause.

You agree not to use the Services for any purpose that is unlawful or prohibited by these Terms. You agree not to:

• Use the Services for any illegal purpose or in violation of any local, state, national, or international law
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of our applications
• Use automated systems, bots, scripts, or other methods to access the Services in a manner that sends more request messages than a human can reasonably produce
• Interfere with or disrupt the Services or servers connected to the Services
• Transmit viruses, malware, or any other harmful code or programs
• Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
• Use the Services to harass, abuse, or harm other users
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Violate any applicable laws or regulations

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Services and all content, features, and functionality thereof are owned by AetherCraft Studio and are protected by international copyright, trademark, and other intellectual property laws. You acknowledge that you do not acquire any ownership rights by using the Services.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes. This license does not include any right to resell the Services or use them for commercial purposes.

6.3 User Content

You retain ownership of any content you submit to our Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your User Content in connection with the Services.

6.4 Feedback

If you provide us with any feedback, suggestions, or ideas regarding our Services, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use such feedback for any purpose without compensation to you.

7. Privacy and Data Collection

8. Advertising and In-App Purchases

8.1 Third-Party Advertising (Future)

Status: Future Implementation

In future versions, our Services may include third-party advertisements. These advertisements may be served by advertising networks including Google AdMob, AppLovin MAX, Unity Ads, IronSource, Mintegral, and Meta Audience Network. These third parties may collect information as described in our Privacy Policy.

8.2 In-App Purchases (Future)

Status: Future Implementation

Future versions may include in-app purchases for additional content or features. These purchases would be processed through third-party payment processors (such as Apple App Store or Google Play).

8.3 Virtual Currency (Future)

Status: Future Implementation

If virtual currency is introduced in future versions, such currency would have no real-world value and cannot be exchanged for real money or other goods of value.

9. Disclaimers and Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AetherCraft STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

IN NO EVENT SHALL AetherCraft STUDIO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESSING THE SERVICES DURING THE PRECEDING TWELVE (12) MONTHS.

11. Indemnification

You agree to defend, indemnify, and hold harmless AetherCraft Studio and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) resulting from or arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the Thai Arbitration Institute. The arbitration shall be conducted in Ratchaburi, Thailand, and the arbitrator's award shall be final and binding.

12.3 Class Action Waiver

YOU AND AetherCraft STUDIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

13. Termination

We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the Services will immediately cease.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and AetherCraft Studio regarding your use of the Services and supersede all prior agreements between you and AetherCraft Studio.

14.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

14.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may freely assign these Terms.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, or governmental regulations.

15. Age Restrictions

Our Services are not intended for children under the age of 13. By using our Services, you represent and warrant that you are at least 13 years old, or if you are under 13, that you are using the Services under the supervision of a parent or legal guardian who has agreed to these Terms on your behalf.

16. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by AetherCraft Studio. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods, or services available on or through any such websites or services.

17. Digital Millennium Copyright Act (DMCA)

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our Services, please notify our copyright agent immediately. Your notice must include:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and under penalty of perjury
